Subject to the approval requirements,
requests for fencing will not be considered unless they conform to the
following restrictions. Wood: All fencing material shall be of natural cedar, natural redwood or weather treated wood. All wood must be stained with Olympic solid body redwood stain. No paint is allowed on fencing. Construction: Fence posts must have a maximum spacing of eight (8) feet, must be not closer than three (3) inches to the building and must be secured in concrete at least 42 inches into the earth. The fence must be free-standing. Location: Side fencing is the only type permitted and must not extend beyond the front line of the Unit. Patios and/or privacy fences may extend a maximum of fifteen (15) feet from the Unit. Easements: Any fencing erected over utility easements are subject to be disassembled for necessary utility line repairs. The cost of re-assembling said fencing is to be borne by the Owner. There must be at least a three (3) foot easement between the patio/fence and existing sidewalks. If the building of a 15 foot patio/fence would not allow for the required easement, then the maximum patio/fence will be dictated by allowance for the FULL three foot easement. The only exception of this rule will be where a privacy fence as originally installed by Kaufman and Broad encroaches upon the three foot easement in which case, the patio/fence may be installed to this fence line. Fully Enclosed Fencing: If the fencing is to completely enclose the unit, a gate of the same style which opens into the common ground area and which can also be opened from the outside must be installed. Owners who cause such gates to be locked from the inside must open the lock so that necessary maintenance services can be performed. In cases of emergency, any locked entry will necessitate entry by Association personnel and any damages caused by a locked entry will be the responsibility of the Owner for repair. Responsibility: An owner is totally responsible for the maintenances of the fence, fenced in area and six (6) inches around the outside of the fence. Applications: Although fenced-in yards preclude prior approval for modification within the yard, the Owner should be forewarned that if those modifications cause drainage r other problems for adjacent Units, the Owner will bear the responsibility for any legal action taken against him. Alterations of existing topography are therefore discouraged. It is the Owner's responsibility to contact all utility companies for location of utility lines before any digging is done. Please be aware that all public utility companies have the right of access to the Property. Small garden fences may be no higher than twelve inches (12"). Vegetable Gardens: Owners wishing to plant small vegetable gardens may do so providing that the plantings are contained within their fenced patio area. At no time, shall plantings of corn or other large vegetables be grown in an unsightly manner or visible from the street. Flower Boxes: Application must be made
to the ACC prior to installation. Determination will be based on
location, size and aesthetics as it relates to each particular Unit
Flower posts and planting barrels may be used as planters within fenced
patio areas without submitted applications for ACC approval as long as
they do not contain plantings exceeding the height of the fence. |
