Two spaces are provided per Unit. If you have a garage, these two spaces are (1) your garage an (2) your driveway. If you have no garage, you have been assigned two (2) spaces in one of the parking areas as near as possible to your Unit All parking spaces that are designated "Permit Parking" are reserved for the exclusive use of the Owner leasing the space. No Resident or guest shall park on the Association's streets for greater than 72 hours. Any vehicle parked on Association streets for greater than 72 hours will be towed at the Owner's expense. Moving a vehicle to another spot on the street will not satisfy this rule. Similar to local ordinance HE-11-1305, "Parking Limited During Snow Removal," it shall be unlawful for any person, firm or corporation to park or cause to be parked any vehicle on any privately owned association street subject to Association snow removal operations at any time within eight (8) hours after a snowfall of two (2) inches or more has occurred, unless within said time said street has been cleared of snow, provided that said eight-hour parking restriction shall continue during snow removal operations until completed. The Association will authorize its licensed commercial towing contractor to remove and tow away any car or other vehicle illegally parked which prevents and obstructs snow removal or emergency equipment from its streets. Cars or vehicles so towed away for illegal parking shall be restored to the owner or operator of such vehicle upon the payment of the towing and storage fees. Only parking of permitted vehicle in a single parking space is permitted. Parking in front of entrance ways or in fire lanes is expressly prohibited. The Board may designate any areas of the Property to be "no parking" areas. Parking in any area identified as a no-parking area is prohibited. No permitted vehicle shall be parked, maintained or stored so as to obstruct passage of other permitted vehicles or emergency vehicles. Vehicles of any type are restricted to the drives and parking areas of the Association, unless specifically authorized otherwise by the Board and/or its agents, and then, not only for Association purposes. There shall be no parking on routes of passage across any other portions of the Common Elements, including all turf areas, sidewalks and fire lanes. Any vehicles that is parked, maintained or stored on the Common Elements, other than drives or parking areas, and in particular a fire lane or in areas designated by the Board and identified as a no-parking areas, may be removed by the Association without notice to the vehicle owner and at the vehicle owner's expense. Vehicles shall not be parked, maintained or stored in a manner which interferes with ingress to and egress from a driveway or other Common Elements. Any vehicle that is parked, maintained or stored in violation of this section is considered to be interfering with ingress from a Unit for emergency purposes, or to be interfering with ingress to and egress from a Unit for the protection, health, safety, comfort and welfare of the respective family residing therein their respective visitors, household help and other authorized individuals, and such vehicle may be removed by the Association without notice to the owner of said vehicle and at the vehicle owner's expense. Any vehicle that is abandoned may be removed by the Association without notice to the owner of said vehicle and at the vehicle owner's expense. Only vehicles authorized to park in Association parking spaces may be parked in those areas. No vehicle repairs, greasing or oil changes are allowed on the drives, parking areas or other Common Elements Emergency repairs can be permitted if necessary; however, any damage caused to the Common Elements by an Owner, his visitor, tenant, family or invitee shall be paid for by that Owner. The Association or its agent, when apprised of a possible violation of any of the above noted Rules, shall investigate and determine whether a violation has occurred. If the Association determines that a violation has occurred, it may take any or all of the following actions, in addition to removal of the vehicle for the reasons and under the circumstances noted: Attach a notification sticker to the vehicle owner and notify said owner of the violations. Record the vehicle identification, including license number, vehicle sticker, date of violation, type of violation and vehicle owner, if known. Identify or attempt to identify the vehicle owner and notify said owner of the violations. Identify the unit owner and/or resident whose vehicles is causing the violation or to whose visitor or invitee is causing the violation. Notify the commercial towing company asking that they remove the vehicle. Follow the procedures in the enforcement policies set forth in that section of these Rules and Regulations. Upon receipt of the Notice of Violation, an Owner must follow the procedures set forth in the enforcement policy. The Board may designate a person, persons or a committee to make determinations of violations and to place stickers and notices on vehicles. Members of the Board or its agent shall notify the appropriate companies or individuals to remove vehicles. The Association has contracted with a towing firm and has erected the necessary signs to effect towing within the Property. All cars parked in violation of these Rules are subject to towing without notice. The tow company is authorized to enforce the above regulations upon their inspection or regular surveillance procedures and/or by authorized contact by Association or its management. if you have any problems with illegally parked vehicles, you are asked to report them immediately to these persons, who will act upon them accordingly. Owners will be charged for any service call to remove a vehicle directly from the tow company if tow has been effected in order to retrieve their vehicle or from the Association if the service is ordered and the car removed prior to the tow truck's arrival on the property. Owners are responsible for the actions and subsequent parking violations of their tenants (s) and visitors (s) to the Property. It is imperative that you instruct these persons properly to avoid unnecessary towing and inconvenience. Towing is being done with a reputable company under the current State statutes and requirements. |
