
GENERAL
RESTRICTIONS
The following
restrictions apply if a unit owner chooses to plant his own flowers or
foliage plants:
Plantings
are not permitted prior to April 1 of each year.
Plantings are not permitted after October 31 of each year.
All dead plant material must be removed and properly disposed of.
SHRUB/FLOWER
BEDS
Planting
of decorative flowers and foliage plants exceeding 24 inches mature height
is not permitted.
Enlargement of existing beds is not permitted.
Planting must not interfere with the landscape contractor's duties. The
landscape contractor with the consensus of the Board or managing agent
has the authority to remove the plantings without financial restitution
to the unit owner.
Plantings must be properly maintained. If (in the opinion of the landscaper,
the Board or managing agent) plantings are improperly maintained, the
landscaper will remove them without notice or financial restitution to
the owner.
Beds must be returned to their original condition by October 31, of each
year; i.e., all dead plant material must be removed.
All Flowering plants must be kept within the existing planting beds.
Vines and vegetable gardens are not permitted.
LANDSCAPING
The Townhouse
Owner' Association will be responsible only for maintenance of trees,
bushes, and sod originally planted by- the developer or approved by the
Board of Directors.
Watering of lawns, bushes, and trees is the responsibility of the homeowner.
Wheaton regulates when homeowners can water their property. Check with
City of Wheaton for regulations, as they may change from time to time.
The addition or removal of any planting must have prior approval from
the Architectural Control Committee. Within the context of this provision,
minor planting of flowers within the existing planting beds of the townhome
owner that are in good taste and in keeping with the general landscaping
scheme of the property of the Association will not require prior committee
approval. The Board of Directors reserves the sole right of determining
the definition of "good taste".
Absolutely no sod shall be removed without prior written approval of the
Board of Directors.
The townhome owner shall be responsible for restoring the property to
its original condition should the owner decide that he no longer wishes
the change.
DAMAGE
The cost
of replacing dead shrubs, lawns, or trees due to lack of watering will
be billed to the property owner.
HOLIDAY
DECORATIONS
TIME RESTRICTIONS
Exterior
holiday decorations are only permitted November through January. (With
exception for displaying a flag or Halloween).
PLACEMENT
RESTRICTIONS
Holiday decorations
are not permitted on sidewalks or driveways.
HANGING/DISPLAYING RESTRICTIONS
Apparatus
used for hanging and/or displaying decorations may not be permanently
affixed to any exterior part of the building.
DAMAGE
Any damage
caused by the hanging of decorations to the exterior units shall be repaired
by the unit owner responsible or by the Board with cost of repair charged
to the unit owner by the Association.
