Patios and decks

Requests for the installation of a patio or deck in the rear yard must be made to the Board of Directors on the standard Exterior Modification Form.

All requests for the construction of a deck or patio must also include:

a. estimate of total cost
b. dimensions
c. complete description including a sketch or plan of the deck or patio
d. copy of the plat of survey with the deck or patio sketched in. Do not submit original plat of survey; it will not be returned.

City Permit Required/Zoning Restrictions - Upon obtaining an approved Exterior Modification Form from the Board, the owner shall obtain a permit from the City of Wheaton as required by Wheaton Building Code, and shall submit a copy of the said permit to the Management Company prior to making the approved modification. In addition, City zoning restrictions may apply; compliance is owner responsibility.

Owner/builder must comply with City inspection requirements.

Minimum Requirement for Decks/Patios

Approved concrete footings must be used. A copy of the specifications can be obtained from the Management Company. Please note that this specification DOES NOT allow wood posts to be buried in concrete. Concrete pier (footing) should extend below frost lines- that is 42 inches below surface- and be 8 inches in diameter. Pier should extend above ground to allow drainage and prevent wood from rotting. Support posts should be anchored to top of concrete pier using a galvanized seat or angle clips bolted to pier and post.

Deck or patio must not extend into the common property or over a utility easement without prior written authorization by all utilities involved. Owner assumes all liability for any infringement of the public utility easement.

Railings up to four (4) feet high are permitted. Solid walls are not permitted. Owner may install vertical, louvered railings (no lattice railings are allowed), or Board approved shrubbery for additional privacy.
 

Redwood, cedar or treated lumber must be used for all deck surfaces/structures. Redwood and cedar may be left the natural color; treated lumber may be stained redwood or left natural.
 

Decks must be enclosed to the ground. Enclosure must be solid wood; no lattice is permitted.
 

6. All ground beneath the deck must be covered with black plastic, which will extend a minimum of 8" beyond deck. This border area will have a V-trench dug to facilitate lawn maintenance and prevent grass encroachment into the border. This 8" border must be covered with mulch or wood chips and may be planted. The use of polyethylene border stripping is expressly prohibited.
 

No storage of any type is permitted on or under deck.
 

Emergency exit from basement must remain usable as an emergency exit. The smaller basement window, under the deck, must be covered to avoid animal entrapment in the window well.
 

Patios must include footings six (6) inches below ground level and must incorporate wire mesh for stability.
 

All maintenance of patios and decks is the owner's responsibility.
 

Window air conditioners, exterior window fans, exterior television or radio antennas, and clothes lines are not permitted. Cable TV cable entry point into the building is to be on the brick at the foundation wall; cable is not to be extended on the exterior of the building to second story, attic, etc. (See also Satellite Dish Antennas.)
 

Permanently installed gas grills require submission of an Exterior Modification Form. Residents are encouraged to locate these devices in the rear yard; however, if they must be in front, they must be installed on the existing concrete slabs AND MUST NOT BE PLACED UNDER ANY PORTION OF THE ROOF.
 

Play equipment, pools, bikes, motorcycles, etc. may not be stored or left out on the front porches and/or patios.
 

Umbrella tables and/or canopies are not permitted in the front of buildings on patios, porches, mulch/rock areas or lawns.
 

Outdoor furniture may not be stacked and/or stored on front patios/porches. Seasonal items (portable grills, planters, plastic child's pool, patio and/or porch furniture, sand boxes, etc.) shall be removed form front and rear patios, porches and/or decks during the off-season.

Information concerning city permits and a copy of the request form are available on the City of Wheaton website:  http://www.wheaton.il.us

If building within a utility easement, the homeowner needs to obtain permission from each of the utilities.  The homeowner must submit letters from each of the utilities before the City of Wheaton will issue a permit.

Here are the contacts at each utility.  The homeowner will need to submit a letter requesting permission to build, along with a copy of the plat of survey with deck/patio drawn in.

A call must be placed to J.U.L.I.E. (Joint Utility Locating Information for Excavators) at 1-800-892-0123 at least 48 hours prior to any construction. Member companies will locate the underground utilities to help avoid damage while excavation.
