NOTICE OF FINE AND FINE POLICY

(Adopted 08-08-06)

I. First notice

 Ø      When a violation of the rules and regulations occurs, written notice is sent to the owner

¨      Explaining what the violation is,

¨      Explaining the rule/ordinance that was violated,

¨      Advising that he/she has 10 days to satisfactorily address the violation,

¨      Advising that a $100 fine will be assessed if the violation is not satisfactorily addressed during the 10-day period., and that thereafter

fines will double ($200 > $400 > $800 > $1,600 etc.) at 10-day intervals,

¨      Advising that the situation will be monitored during this period

¨      Owner will be invited to the next regularly scheduled Board meeting. 

       II. Second notice

Ø      Written notification is sent to owner

¨      Explaining this is a second notice,

¨      Explaining what the violation is,

¨      Explaining the rule/ordinance that was violated, 

¨      Advising that he/she has 10 days to satisfactorily address the violation,

¨      Advising that the situation will be monitored during this period,

¨      Advising that the $100 fine has been assessed to the owner’s account, that a $200 fine will be assessed if the violation is not satisfactorily addressed during the 10-day period, and that thereafter fines will double ($400 > $800 > $1,600 etc.) at 10-day intervals,

¨      Additionally, advising that if the violation is not satisfactorily addressed during this and subsequent 10 day periods, that a vendor may be sent to address the violation, with notice being sent to the owner, and with the cost to be charged to the owner’s account. The amount will be the reasonable and customary rates charged by the vendor.

¨      Owner will be invited to the next regularly scheduled Board meeting.                       

      III. Third notice, same problem

 Ø      Written notification is sent to owner

¨      Explaining this is a third notice,

¨      Explaining what the violation is,

¨      Explaining the rule/ordinance that was violated, 

¨      Advising that he/she has 10 days to satisfactorily address the violation,

¨      Advising that the situation will be monitored during this period,

¨      Advising that the $200 fine (plus any vendor cost) has been assessed to the owner’s account, that a $400 fine will be assessed if the violation is not satisfactorily addressed during the 10-day period, and that thereafter fines will double ($800 > $1,600 etc.) at 10-day intervals (plus any vendor cost) in the event the violation is not satisfactorily addressed,

¨      Advising that if the violation is not satisfactorily addressed during the 10 day and subsequent periods, that a vendor may be sent to address the violation, with notice being sent to the owner, and with the cost to be charged to his/her account. The amount will be the reasonable and customary rates charged by the vendor.

¨      Owner will be invited to the next regularly scheduled Board meeting.   

      IV. Subsequent notice(s), same problem 

Ø      The situation will be monitored. If the violation is not satisfactorily addressed

      during the 10-day intervals:

¨      Fines will double and be assessed to the owner’s account at each 10-day interval,

¨      Any vendor charges will be assessed to the owner’s account.
