Failure to comply with the applicable Rules and Regulations regarding leasing will result in fines equal to double the fees that would have been paid if the Unit Owner had abided by the Rules and Regulations. Every lease will be in writing and will be subject in all respects to the provisions of the Declaration and Bylaws, and Rules and Regulations of the Association. All information supplied by the Unit Owner and/or their Lessee will be kept confidential and will be used for Association purposes only. In the event a Unit Owner and/or their Lessee fails to cooperate with the Board in providing the information requested in this section, the Board may suspend the rights and privileges of the Unit Owner and/or their Lessee until the requested information is supplied. Furthermore, all costs and expenses of the Board in obtaining the requested information, including attorneys' fees, will be assessed to the account of the Unit Owner as a Common Expense. If the present Unit Owner fails to lease their Unit to the Lessee for whom information has been supplied or fails to complete the lease arrangement, the Unit will again become subject to the same Rules and Regulations as set forth in this section as to the Board's first right and option. If a tenant violates any provision of the Declaration and Bylaws, or Rules and Regulations, the Board, in its discretion, will determine what action or actions should be taken against the Unit Owner or tenant, as the case may be. When the Board, in its discretion, determines that a violation or series of violations warrant termination of the lease, the Board may take whatever action or actions are necessary to terminate the lease. All expenses of the Board in connection with any violations under these rules are assessed to the account of the Unit Owner responsible as a Common Expense. The Unit Owner will be responsible for any damages caused to Common Elements during tenant move-ins and move-outs. The Unit Owner is responsible for providing a copy of the Declaration and Bylaws, and Rules and Regulations to their Lessee at the time of move-in. Costs of additional copies of these documents will be reviewed from time to time by the Board and will be adjusted as deemed necessary.
