All lease
or rental agreements regarding
Unit must be in writing and shall be subject to all terms, conditions
and requirements of the Declaration, By-Laws and Rules and Regulations
of the Association. No Unit may be leased or rented for a period less
than thirty (30) days. The Owner shall provide a copy of the lease or
rental agreement to Board within ten (10) days after its execution or
the date of occupancy, whichever occurs first. The Association is hereby
expressly deemed to be a third party beneficiary of any such lease; and
any violation of the Declaration, By-Laws or Rules and Regulations shall
be deemed a default under such lease entitling the Association to exercise
any and all remedies under the lease or available at law or equity, regardless
of the Owner's action or inaction in response to such default.
Any Unit that
is non-owner occupied is considered a "rental unit" . The owner is
responsible for registering said Unit with the Village of Fox Lake. A
copy of the Certificate of Compliance issued by the Village of Fox Lake must
be presented with the copy of the executed lease before the Unit is
occupied.
All owners of
"rental units" must keep a current address, home phone number, business
phone number and cell phone number on file with both the Village of Fox Lake
and the association's management company.
Homeowners in
violation of sections A,B, or C are subject to a $500 per month fine
assessed against the unit starting at the time the Unit is vacated and/or
non-owner occupied.
