All issues and concerns must be brought to the attention of the management agent and/or Association Board of Directors by the actual unit owners. Tenants must express their concerns to the landlords, who will bring the concern to the attention of the Board. There are no exceptions. Off-site owners must provide copies of current leases on an annual basis to the management agent, indicating all occupants. Each unit owner shall be responsible for his or her tenants with copies of the HOA Rules and Regulations. Conversely, tenants are responsible for keeping off-site owners apprised of all entrance area, and door drop postings and announcements. In the event of violation of the HOA Rules and Regulations by a tenant, the Board, in its discretion, shall determine what action or actions are necessary against the unit owner or tenant, as the case may be. When the Board, in its discretion, determines that a violation, or series of violations, warrant termination of the lease, the Board may take whatever action or actions necessary to terminate the lease. Any non-resident owner who resides outside the immediate area shall provide the Board with the name of a local agent (e.g. real estate agent, family member, and attorney) who will represent the non-resident owner in matters regarding the leased unit and will have the full power to action in the owner's behalf regarding the lease and leased unit. Non-resident owners are expected to maintain and active interest in the management of the property in which their units are located and in the affairs of the HOA. All unit owners who do not reside in a unit owned by them, shall provide the Board with their permanent residence address and phone number where they may be reached in an emergency. Any expenses of the Board incurred in locating a unit owner who fails to provide such information shall be assessed to that unit owner's account. All costs and expenses incurred by the Board in connection with any violations under these rules shall be assessed to the account of the unit owner responsible therefore as part of his or her common expense. Renters must observe and abide by all HOA rules and regulations, just as a unit owner must. Any damage to common property will be the responsibility of the unit owner. |
