In accordance with the Illinois Condominium Property Act, if someone is believed to be in violation of any of the provisions of the Declaration and by-laws or Rules and Regulations, a signed, written complaint must be submitted by an owner, the managing agent, a resident or a member of the Board of Directors. A written complaint form prescribed by the Board shall be sent to the management firm. See Exhibit A.

The person charged with the violation (defendant) will be given written notice of the complaint, informing them they can request (in writing) a hearing date - within 14 days - at that time, the defendant will have the opportunity to defend themselves. If a written request for a hearing is not received within 14 days, or the defendant does not appear at the et date and time assigned to their written request for a hearing, a determination will be made based on the information that is available. If the defendant is a tenant, the unit owner or their representative must be present. The tenant cannot be the unit owner representative.

If any resident or unit owner is found guilty of a violation, the Board will notify the guilty party in writing, Exhibit B, and a fine may be charged to the assessment account of the owner of the unit in which the guilty person resides and be collected with the monthly assessments.

There will be a fifty-dollar ($50.00) fine for each non-pet related violation, provided the owner has not previously been fined for the same violation in the last year. If the owner has been fined for the same violation in the last year, each subsequent fine will be one hundred dollars ($100.00). There will be a twenty -five dollar ($25.00) per day fine if a violation is of a reoccurring nature or an issue of safety. The fine amount for pet violations is addressed separately in the Pet Section 16 of this document.
