All pets must be registered with Association management using Exhibit H. Any pet not registered will be considered in violation and are subject to legal action with possible removal of the pet. All pet owners will be required to pay a $100.00 pet fee per pet each year. No animals other than dogs, cats or other animals reasonably considered to be household pets shall be maintained and kept on the property. No animals may be bred or kept anywhere on the property for any commercial purposes. A maximum of two (2) pets may be kept within a unit with a maximum combined weight of 65 pounds at maturity. Pets must be licensed, as required by the Village of Streamwood, and vaccinations must be kept up to date. Documents to prove same must be made available to the Association. All dogs must be leashed anytime they are outside the unit, being carried or while being walked outdoors, in transit, or on any Common Elements. Playing with pets in the hallways and /or stairways is not allowed. No pet shall be left unattended or tied up or staked out at any time while on the common areas or outside of the unit. Balconies and patios shall not be used as pet runs. Dog owners are responsible for removing defection waste matter created by their dog immediately after it occurs. Plastic bags should be used for this, and the waste matter must be placed in the residents trash receptacle. This mandatory regardless of the weather conditions. Any pet owner not complying with this requirement will be found to be in violation of this rule and subject to a substantial fine. No pet shall be allowed to create a nuisance or unreasonable disturbance or damage any Common Elements or the property of any resident or unit owner. Cats are not allowed outside the unit at any time, unless in transit within a pet carrier or on a leash. All unit owners are responsible for actions of pets residing in or visiting their unit, and the costs of repairing any damage caused by a pet shall be assessed to the unit owner responsible. Any unit owner who has been found to be guilty of any violation of the above rules shall be deemed to be liable for having a pet, which causes or creates a nuisance or unreasonable disturbance. Thereafter, the Board, after consideration of the facts and circumstances, may, in its discretion, assess a fine (see section 28D and 29) and /or will seek a court order for removal of the pet. Any unit owner, lessee, Association officer or employee, noting litter or damage to any property caused by a pet, shall report the litter or damage to the association, identifying the pet, or if its ownership cannot be determined, the unit in which the pet is kept. This report should be made using the standard complaint form, Exhibit A, which entails making a person submitting the complaint the witness to the violation. The Association, upon notification as provided herein, shall notify the pet owner, if known the unit occupant and the unit owner of the disturbance or litter and/or damage caused to any property. Notification shall be made by regular mail or personal delivery to the aforementioned parties. If the unit owner believes the Association notice provided herein to be unjustified they shall within fourteen (14) days of the sate of such notice, file a protest and request for a hearing, in writing to the Association. If you fail to request for a Hearing or fail to appear at a hearing, you will be found guilty by default. The Board shall hear from all parties involved in the complaint and shall conduct a brief informal hearing. At the time, all evidence shall be presented and may be examined by the accused. THereafter, the Board shall deliberate in private. The Board shall, at its next regular scheduled meeting, ratify the findings of the hearing, reject them or modify them, and thereafter notify all parties, via a Notice of Determination as to the findings. The decision of the Board of Directors shall be final. Fines, charges, costs, expenses and legal fees may be assessed against the homeowner and added to the assessment account. The fines are collected in the same fashion as the monthly assessments. Notwithstanding the foregoing, any person who, contrary to the Village of Streamwood ordinance, permits their pet or pets to run unleashed on any property other than their own private property (within the boundaries of their unit) shall be subject to the same rules, sanctions and penalties as stated above.
