The number of rentals has been frozen, so that leases for units that are not currently leased will not be approved. Leases must be on file for all units that are rented. Leases must be on file for units leased by family members. Failure to provide a copy of the lease within 30 days of the move-in will be subject the unit owner to a $100.00 fine. Homeowner / Tenant Questionnaires must be completed by each unit owner on an annual basis. Failure to return a completed questionnaire within 30 days of receipt will subject the unit owner to a $50.00 fine. All Owners who do not permanently reside in the unit owned by them shall provide the Board with a permanent residence address and phone numbers (both home and work) where they may be reached in an emergency. Any expense of the Board incurred in locating an Owner who fails to provide such information shall be assessed to that Owner's assessment account. unless otherwise provided by law, any Owner who fails to provide such information shall be deemed to have waived the right to receive notices at any address other than the address of the unit, an the Board shall not be liable for any loss, damage, injury or prejudice to the rights of said Owner caused by any delays in receiving notice. No Owner may lease less than the entire unit owned by him/her (unless the he/she resides in the unit), and no unit may be leased for transient or hotel purposes. All leases must be for a term of at least one year. Each Owner who leases his/her unit shall provide the Board with a copy of the Lease and any and all Riders within 10 days after execution and, in any event, prior to Tenant's occupancy. Said Lease shall be in conformity with the Declaration, By-Laws and the Rules and Regulations, as amended from time to time, and shall specifically provide it is subject to same. Owner shall furnish the Board , on a yearly basis, a coy of any Lease then in effect as to his/her unit. Each Owner shall provide his or her Tenants with copies of the Declaration, By-Laws and Rules and Regulations of the Association prior to or at the execution of the Lease. In the event of any violation of the Declaration, By-Laws or Rules and Regulations of the Association by Tenant or guest of any Owner or Tenant, the Board may take the necessary legal action against the Owner and/or Tenant, but the Owner shall in any event be liable for any such violation. All expenses of the Board in connection with any violations under these Rules shall be assessed to the account of the Owner. Each Owner who leases his/her unit shall attach as a Rider to said Lease the document commonly known as "Rider of Lease", attached hereto as Exhibit "A" and made a part hereof, and a copy of the fully completed and executed Lease and Rider shall be deposited with the Association prior to tenancy of Tenant . Subleasing by Tenants is prohibited.
